June 8 Debra J. Pittenger, 38, of Newton, pled guilty to the fourth degree crime of aggravated assault, driving while intoxicated and driving while intoxicated with a minor in the vehicle. She admitted that on April 12 she was operating a motor vehicle while under the influence of alcoholic beverages, crossed a double yellow line and struck an oncoming motor vehicle thereby injuring the other operator. She had a child in the car at the time this occurred. June 12 Michael Wargacki, 34, of Wantage was sentenced to two years probation. As a condition of probation he is to serve 90 days in the Sussex County Jail. In addition, he was ordered to pay $405 in monetary penalties and to continue with his intensive outpatient substance abuse program. Wargacki was also sentenced for a second driving while intoxicated offense. On the DWI conviction he was sentenced to a two-year driver’s license suspension, a two-year registration revocation, 90 days jail to be served concurrent with his criminal court sentence, and 30 days community service. He was also ordered to pay $825 in monetary penalties related to the DWI conviction. He pled guilty on April 15 to three counts of the fourth degree charge for violating the terms of his community supervision for life. Under the provisions of Megan’s Law, Wargacki was subject to community supervision for life. As part of his community supervision for life, Wargacki was required to notify his parole officer of an arrest. In addition, Wargacki was not permitted to consume or possess alcoholic beverages. Wargacki admitted to the court that on Oct. 31, 2007 he was under the influence of alcohol in violation of his community supervision for life. In addition, he admitted that on Nov. 6, 2007 he was arrested for driving while intoxicated in the Borough of Hamburg. In addition, between Nov. 6, 2007 to Nov. 21, 2007 he failed to notify his parole officer that he had been arrested for driving while intoxicated. Caitlin A. Borras was sentenced with respect to her convictions of conspiracy to commit burglary and unlawful possession of a weapon with respect to an armed burglary of a Frankford Township residence committed by co-defendants on October 16, 2007. Borras, 20, of Newton, was sentenced to four years state prison with one year stipulated parole ineligibility. Borras was given 21 days jail credit. Penalties and assessments of $380 were imposed and $2,214.89 in restitution was ordered to be paid to the victim on a joint and several basis. Bruce Damore, 24, of Hamburg was sentenced to four years New Jersey State Prison, was given credit for 60 days served, plus 59 days GAP time and his New Jersey driver’s license was suspended for 12 months. He must pay total fines and penalties of $2,705, pay restitution to several victims in the amount of $6,059.50 joint and several and must submit a DNA sample at his expense. He pled guilty on May 19 to seven counts of burglary and one count of possession of crack cocaine, all third degree crimes, and to the fourth degree crime of aggravated assault. Between December 16, 2007 and January 31, 2009 in Wantage, Sparta, Newton, Vernon, Hardyston, Hamburg and Franklin, Damore and several co-defendants broke into vehicles and took items including credit cards and checks, which they used to make purchases and get cash for themselves. On March 25, 2008 in Franklin Borough, during an investigation involving the defendant using profane language towards fast food restaurant workers, a pat down revealed crack cocaine on his person. On August 6, 2008 in Newton, while being arrested for giving police false information, he spat at one of the officers who was attempting to escort him from the police vehicle into the police station. June 15 Jason McKevitt, 50, of Hopatcong pled guilty to two counts of third degree aggravated assault on two police officers and fourth degree throwing bodily fluids at a police officer. McKevitt admitted that on or about Oct. 2, 2008 he had been involved in a domestic violence dispute that resulted in his being arrested by the police. During the course of the investigation by law enforcement, McKevitt assaulted Officers Tracey and Maresca of the Hopatcong Police Department. In addition, while under arrest, he spit on a police officer. Leonard W. Bonter, 40, of Montague pled guilty to the second degree crime of possession with the intent to distribute a controlled dangerous substance. He admitted that on March 27 he possessed approximately 50 grams of cocaine, which he intended to sell from his home in Montague. June 16 Robert J. Douglass, 34, of Vernon pled guilty to receiving stolen property, a fourth degree crime. On Sept. 17, 2006 in Vernon, he bought a log splitter that he knew had been stolen and sold it to someone else. Lenny Syfor, 23, of Newton pled guilty to one count of child abuse, a fourth degree crime. On August 10, 2008 the defendant had a minor under the age of 16 touch him inappropriately. Barth Stewart, 56, of Sussex entered a guilty plea to an indictment charging him with one count of a fourth degree charge for a Megan’s Law violation for failure to notify law enforcement that he had moved to a new address. Under the provisions of Megan’s Law, Stewart was required to notify the local police that he was moving to a new address 10 days prior to his actual move. Stewart admitted to the court that between Dec. 1, 2007 and Dec. 11, 2007 he had moved to a new address in Sussex Borough without first notifying the Newton Police Department of the change in his address. Lauren L. Hansen, 23, of Franklin indicted with vehicular homicide, a crime of the second degree. The indictment alleges that on July 25, 2008 in the Township of Wantage, Hansen recklessly drove her vehicle, while intoxicated and collided with a motorcycle being operated by Thomas J. Klosterhoff, causing his death. Joseph J. Cavanaugh, 25, of Vernon was indicted with vehicular homicide, a crime of the second degree and assault by auto, a crime of the fourth degree. The case was investigated by the Vernon Police Department and the Sussex County Sheriff’s Department. The indictment alleges that on Aug. 2, 2008, in the Township of Vernon, Cavanaugh recklessly drove a vehicle, while intoxicated, thereby causing the death of Ryan Olsen and bodily injury to Jason Concoy, both passengers in the vehicle. Frank Aigotti, 27, of Wantage Township was indicted with burglary, theft, and criminal mischief, all crimes of the third degree. The case was investigated by the New Jersey State Police. The indictment alleges that on March 4, 2008 in the Borough of Sussex, Aigotti unlawfully entered a building owned by Stephen Giordano, taking movable property and causing damage in excess of $2,000. Felix J. Silverio d/b/a J & F Auto Sales, of Hackettstown with third degree theft by deception and third degree theft by failure to make disposition of property received. The grand jury alleges that on Dec. 3, 2008 Felix J. Silverio purchased a 2005 Honda CRV-EX from Max’s Neptune Enterprise of Hopatcong using a check written on the account of J & F Auto Sales in the amount of $11,300 that was returned for non-sufficient funds. June 19 Nicholas A. Scalici, 19, of Vernon, was sentenced to three years probation, was ordered to serve 30 days in the Sheriff’s Labor Assistance Program, ordered to perform 200 hours of community service, must submit to random urine monitoring, obtain and maintain gainful employment and continue intensive outpatient program treatment and follow all aftercare instructions. He must pay restitution to two victims and his driving privileges were suspended for six months. He must pay total fines and penalties of $2,525 and submit a DNA sample at his expense. He pled guilty on Jan. 26 to burglary and possession of heroin, both crimes of the third degree. He pled guilty on June 19 to possession of heroin. On Sept. 9, 2008 in Vernon, he broke into a condominium unit through a window and was caught by an acquaintance of one of the residents of the condo. He later admitted his actions to police upon being questioned. On Nov. 3, 2008, again in Vernon, he was a passenger in a vehicle that was stopped for a motor vehicle violation and was found to be in possession of heroin. On March 9, 2009 in Vernon, a bag of heroin was found in a vehicle Scalici was driving that was at the scene of an attempted vehicle break-in on that date. Cory Coulson, 21, of Wantage, was sentenced to two years probation and a three month driver’s license suspension. He must also undergo random drug testing, remain medication compliant, complete 100 hours of community service, maintain employment, submit a DNA sample, have no contact with the victim, pay $2447.66 in restitution to the victim and $205 in court fines. He pled guilty on March 9 to fourth degree unlawful possession of a weapon. He was in possession of a paintball gun in October of 2008 and shot it at the victim’s home and vehicle in Wantage while with several juvenile co-defendants.
