Franklin faces $1M tort claim

Michelle Ayala, who was asked to "cover up or leave" the pond beach area while breastfeeding her 2-year-old child on Aug. 3 has filed a tort claim against the borough, according to Borough attorney John Ursin.
She is seeking up to $1M in damages.
Residents in attendance at Tuesday's meeting applauded Officer Nick Della for what they called his proper handling of what they refer to as "The Beach Incident".
Della Fera found no wrongdoing by Ayala.
Lindsay Campbell, from the Stanhope National Organization of Woman, addressed the Council and said women breastfeeding in public “should not have to explain” and is “baffled” as to how this could happen. It was during her speech in front of Council that she thanked Franklin Borough Police Officer Nick Della Fera for his actions and the applause was heard throughout the room.
Prior to public comments, Franklin Borough Attorney John Ursin said the council members would not be allowed to offer individual comments or represent the Borough with comment due to the claim.
Franklin Borough Mayor Giordano called for executive session, which closes the public from hearing portions of the meeting. Attorney Ursin cited litigation and personnel issues as the reason for the executive session.
