Arrests and charges

    The following individuals were arrested as a result of the early morning law enforcement activities:
    • Brandon G. Masker, 33, Warwick. Charged with operating as a major trafficker.
    • Anthony J. Spagnola, 56, Cuddebackville. Charged with operating as a major trafficker.
    • Miguel Galvan, 36, Vernon, N.J. Charged in New York with first-degree Criminal Possession of Controlled Substance and fourth-degree conspiracy. Charged in New Jersey with: maintaining or operating a controlled dangerous substance production facility in the first degree; first-degree possession with intent to distribute cocaine; second-degree certain persons not to possess weapons; second-degree possession of weapon and controlled dangerous substance and other offenses; and fourth-degree prohibited weapons device.
    • Ryan M. Culver, 29, Otisville. Charged with second-degree conspiracy and third-degree criminal possession of a controlled substance.
    • Charles M. Sawtelle, 53, Westbrookville. Charged with second-degree conspiracy and fifth-degree criminal possession of a controlled substance.
    The following people were all charged with second-degree conspiracy:
    • Cody M. Caplandies, 21, Middletown.
    • Thomas P. Caplandies, Jr., 46, Bloomingburg.
    • Jacob Gavin, 25, Wurtsboro.
    • Wendy Gladkowsky, 50, Cuddebackville.
    • Kevin P. Kelly, 31, Warwick.
    • Robert A. Howell, 55, Warwick.
    • Jenna D. Manapat, 24, Johnson.
    • David A. Nielsen, 47, Middletown.
    • Peter M. Noger, 55, Goshen.
    • Gerald F. O’Brien III, 33, Pine Island.
    • Samantha Weber O’Brien, 33, Pine Island.
    • Anthony R. Rizzo, 53, Warwick.
    • Richard J. Tomczak Jr., 34, Goshen.

    According to the New York State Penal Code, a person is guilty of operating as a major trafficker when:
    • Such person acts as a director of a controlled substance organization during any period of twelve months or less, during which period such controlled substance organization sells one or more controlled substances, and the proceeds collected or due from such sale or sales have a total aggregate value of seventy-five thousand dollars or more;  or
    • As a profiteer, such person knowingly and unlawfully sells, on one or more occasions within six months or less, a narcotic drug, and the proceeds collected or due from such sale or sales have a total aggregate value of $75,000 or more.
    • As a profiteer, such person knowingly and unlawfully possesses, on one or more occasions within six months or less, a narcotic drug with intent to sell the same, and such narcotic drugs have a total aggregate value of $75,000 or more.
    • Operating as a major trafficker is a class A-I felony. The charge carries a sentence of up to a life sentence with a minimum of between 15 and 40 years in prison.
